In year 2000 Switzerland signed its one hundredth Bilateral Investment Treaty (“BIT”), all of which contain dispute resolution provisions. This study focuses on “diagonal” clauses contained in such BITs, i.e., on dispute settlement clauses between host states and foreign investors involving a Swiss investor in the foreign state party to the BIT, or a foreign investor of the latter in Switzerland.
